01Scope

Spotcast displays a brand’s advertising on live streams run by the Agency’s streamers, and records evidence that each display took place. These terms govern the Agency’s use of the platform.

02The Agency’s warranty about its streamers

The Agency warrants that, for every streamer it adds to the platform, it holds that streamer’s consent to promotional use of their channel name and of recordings of sponsored moments, by the Agency and by the Agency’s technology providers, including Spotcast.

The Agency gives this warranty because the Agency, not Spotcast, holds the relationship with each streamer. Spotcast has no means of obtaining that consent directly.

03The creative, and the right to display it

The Agency grants Spotcast the licence needed to store, transmit and display each creative it uploads, for as long as needed to deliver the campaign it belongs to. The Agency warrants that it holds the rights necessary to grant that licence.

The licence is limited to delivering the campaign.

04Promotional use

Where the Agency confirms that a brand has agreed to Spotcast using that brand’s campaign in Spotcast’s own marketing, Spotcast may name the brand and show proof clips from the campaign. The Agency is asked because the Agency holds the relationship with the brand and Spotcast does not. The Agency warrants that each confirmation is accurate when given.

A brand may run a campaign and still decline to be named; the two are separate decisions. Where a brand has not agreed, Spotcast may still describe its own delivery without naming the brand, such as how many streamers took part, how many verified impressions were delivered, how many proof clips were captured, over what period, and for how long ads were on screen.

05Processing of personal data

Spotcast processes personal data on the Agency’s behalf. The data processing agreement annexed to these terms sets out that processing and is accepted together with them.

06Terms agreed separately

Commission and exclusivity are agreed in a separate signed agreement and are not part of these terms.

07Changes to these terms

Spotcast may publish a new version of these terms. Where the change is material, continued use of the platform requires accepting the new version. Each acceptance records the version accepted and the date.
